In addition to the Payment Gateway Services Applicable Terms - Online Terms and Conditions ("Agreement") you shall be fully compliant with the specified requirements below:
MobilePay Online is either restricted or prohibited for use of the below Merchant Category Codes (“MCC”):

Regardless of the registered MCC above, the following products and/or services are prohibited or restricted: bitcoins, stock trade, crypto, binary options, gambling, betting, bonds, money transfers, streaming of porn, debt collection, pyramid schemes, pyramid business models, multilevel marketing, CBD Oil, drugs and other illegal goods and activities etc.
You shall have the obligation to inform Shift4 if you fall within any of the above listed MCCs or blacklisted services. If you fail to do so, it shall be deemed as a breach of this Agreement and you shall be held liable for any damages incurred by Shift4 as a result of such breach.
The above list of Prohibited or Restricted Clients may be amended by MobilePay from time to time.
A Restricted Client is a client that has the following MCC, or provides the following services and may use MobilePay Online services:
In the event of a conflict with the above terms and conditions, these Additional Terms shall supersede.
By signing the Agreement, Client is acknowledging and accepting the following additional terms:
Gambling
1. Shift4 must obtain MobilePay’s prior written approval for each individual gambling Merchant before initiating any onboarding activities. For this purpose, you must provide Shift4 with the following information:
Company information, including full legal name and company registration number.
Your gambling license(s).
A description of your business, including a description of the verification of End Users and verification of disbursement account; a description of the products/services in which the Service is to be used; and estimated volumes and transactions via the Service.
A description of your transaction monitoring and other controls in place to prevent financial crime, including Anti-Money Laundering controls.
You are aware that MobilePay reserves the right, at its sole discretion, to withhold or deny or remove your approval, and Shift4 is not liable for such decision.
2. In order to receive the Service you must:
Hold a valid gambling license from a competent gambling authority within EU/EEA.
Only receive payments by card via the Service for gambling services in the following currency: EUR or DKK.
Comply with all applicable legislation, regulation and guidance at all times, relating to gambling services.
Use any required domestic strong e-authentication (“e-ID”) to verify the identity and age of End Users and to grant access to execute payments via the Service.
Only provide gambling services via the Service to End Users above the age of 18 years.
Ensure that no credit cards are used for the transactions.
Without undue delay notify Shift4 of any relevant remarks and/or orders from national, EU and/or international authorities and/or any relevant changes to your licenses or business descriptions.
Non-compliance with the above-mentioned requirements is deemed a material breach of the Agreement. We have the right to terminate your right to use the Service based on non-compliance.
3. Additional Fee: For transactions made by Finnish End-Users, an additional back-to-back fee set by MobilePay will be applied.
4. Termination:
If purchase/sale of online gambling is prohibited by law and/or is subject to separate regulation and/or intervention by public authorities, regardless of the nature or cause thereof, this supplementary Agreement will automatically terminate at the same point in time.
If your applicable gambling license expires, terminates or is otherwise revoked, and/or you are ordered to cease sales of online gambling and/or the acquirer agreement, the right to use the Service for gambling services will terminate immediately.
You will indemnify us and/or MobilePay for any loss, which we or MobilePay may incur as a result your failure to comply with these obligations
5. Any marketing and/or press release referencing the Service must be pre-approved by Shift4 in writing prior to publication.
Crypto:
1. Shift4 must obtain MobilePay’s prior written approval for each individual gambling Merchant before initiating any onboarding activities. For this purpose, you must provide Shift4 with the following information:
written documentation of your license or written documentation of your compliance with the requirements for non EU/EEA-licensed crypto as defined below,
notify Shift4 immediately if there are material changes to your licenses and/or authorizations,
Notify Shift4 without undue delay of any relevant remarks and/or orders from national, EU/EEA and/or international authorities relevant to you under this Agreement,
provide a copy of your White Paper as required by MiCA to Shift4 if your are licensed according to MiCA when applicable,
provide a business description in writing, which includes:
Your organisational structure
A description of the products/solutions in which you will use the Service
Estimated volumes and transactions with the Service
Description of transaction monitoring and other controls in place to prevent crime, financial crime, money laundering and sanction-evasion.
You are aware that MobilePay reserves the right, at its sole discretion, to withhold or deny or remove your approval, and Shift4 is not liable for such decision.
2. In order to receive the Service you must:
EITHER: hold a valid license as required by REGULATION (EU) 2023/1114 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 31 May 2023 on markets in crypto-assets (“MiCA”) issued by the competent authority of any EU/EEA member state, where MiCA applies, with such license passported (where applicable) to permit operations in the territory where you provide services under this Agreement, and/or a valid license to issue financial services or payment services issued by a competent financial authority within the EU/EEA, and be established in EU/EEA, OR, if you do not have a license within EU/EEA, comply with the following requirements:
hold a valid license, registration, or authorisation to provide crypto asset services issued by a competent authority in the home jurisdiction,
be subject to ongoing prudential, conduct and anti-money laundering and counter terrorist financing supervision by such authority,
not be established in, nor operate from, a jurisdiction listed as high-risk or non-cooperative by recognized authorities, not be subject to any EU or UN sanctions and/or otherwise classified by Shift4 or MobilePay as high-risk.
implement safeguards against fraud and scams, and
have documented and operational controls equivalent to EU/EEA standard, including:
KYC/ODD procedures
Transaction monitoring
Sanction screening and PEP screening, and
Blockchain analytics or equivalent controls to detect suspicious crypto flows.
comply with the at-all time applicable legislation, including but not limited to crypto currency, AML, sanctions, data security, personal data and consumer protection, and
Must ensure that the service is not made available to individuals under 18 years of age and implement adequate age verification measures.
Non-compliance with the above-mentioned requirements is deemed a material breach of the Agreement. We have the right to immediately terminate your right to use the Service based on non-compliance.
3. Transaction Monitoring:
You are aware that we or MobilePay may block, suspend, or delay transactions where necessary to comply with legal or regulatory obligations or to mitigate fraud or financial crime risk.
Where feasible and not prohibited by law or regulatory obligations, we will provide the reason for such action.
Neither Shift4 nor MobilePay shall be liable for any direct or indirect losses incurred as a result of the blocking of a transaction in accordance with this clause, provided that such action was taken in good faith and based on reasonable suspicion.
4. Termination and Indemnification:
If purchase/sale of crypto is prohibited by law and/or is subject to separate regulation and/or intervention by public authorities, regardless of the nature or cause thereof, this supplementary Agreement will automatically terminate at the same point in time.
If your applicable crypto license expires, terminates or is otherwise revoked, and/or you are ordered to cease sales of crypto and/or the acquirer agreement, the right to use the Service for gambling services will terminate immediately.
You will indemnify us and/or MobilePay for any loss, which we or MobilePay may incur as a result your failure to comply with these obligations
